ICANN publishes gTLD contention sets

And sets the world asleep

ICANN has published "contention sets" for the 1,930 applications for new Internet extensions it has received - and left the Internet community wondering what the fuss was all about.

Of all the possible combinations and permutations of names that could be taken to be similar, only four applications that are not exact matches have been chosen: dot-hotels and dot-hoteis; and dot-unicorn and dot-unicom.

Apart from those four, ICANN says there are 230 contention sets of exact matches i.e. people applying for the same name, and 754 applications involved in total - reflecting the infographic we produced back in June 2012 when the applications were first announced (the only difference being that one of the dot-swiss bids has withdrawn).

The markers of lifestyle TV programmes including HGTV and the Food Network have pulled their application for the dot-glean top-level domain.

Lifestyle Domain Holdings, a subsidiary of Scripps Networks Interactive, is behind the bid and is the seventh of 13 withdrawn applications that have been named, indicating that the companies has received its $130,000 partial refund from ICANN.

Dot-glean is just one of 13 applications made by the company and earlier this year it had applied for four trademarks for the "glean" name. It did not give a reason for dropping the application, at a cost of $55,000. It is not known if the company is responsible for any of the other six unnamed withdrawals, although its dot-vana is similar in many respects to dot-glean and may also have been junked. Scripps Networks Interactive also recently received a government "early warning" over its dot-food application last month.

Searching .Nxt's own database for clues

The most clicked link in the .Nxt new gTLD database isn't a potentially contentious string like dot-sex. Instead, it's dot-ismaili.

Ismaili is a branch of Shia Islam with somewhere around 20 million followers worldwide and the application for dot-ismaili as a community gTLD came from the Aga Khan Foundation, founded by the imam of the Ismaili community, so there is probably little chance that anyone in the community will object to the application.

Controversy is brewing over some companies plans to make generic gTLDs private online spaces

In November 1999, in one of its first actions, ICANN came good on its mandate to introduce competition within the Internet's infrastructure and signed an agreement with Network Solutions that required it to allow other companies to sell registrations under the dot-com registry.

It was the beginning of a rule that no Internet registry can sell domain names under its own name, and it should give ready access to other companies that wish to. The result was an explosion of competition, and a drop in domain prices from $50 to $6 a year.

After years of playing the coy .virgin, waiting for the right moment to say yes, the excitement of ICANN's potential suitors is writ large in their .love letters posted in that most unreliable of matchmakers, the TLD Application System (Is that an 18-letter long string in your pocket, or are you just happy to see me working again?)

Not all suitors will be rewarded, and none will get their $185,000 engagement rings back, so it's only fair to award applicants for efforts to stand out in a very crowded room.

The applicant does not represent the global community of rugby players, supporters and stakeholders.

Reason/Rationale: 

The United Kingdom Government has considered the three applications for the “.rugby” string. One of the applicants is the International Rugby Board (IRB) which is the sole world governing body for the sport of rugby. The IRB is responsible for developing the game of rugby across the world and for formulating and controlling the laws of the game. The IRB is recognized as the international federation for rugby by its 117 member unions across six global regions. It is also recognized internationally through its affiliation with the International Olympic Committee and the Commonwealth Games Federation.

Unlike the application by dot.Rugby Limited, therefore, the IRB’s application has the demonstrable support of the international rugby community and as such it is in effect a community application (if not technically so under ICANN’s rules).

In the light of these considerations, the United Kingdom Government believes that the IRB’s application merits priority consideration by ICANN due to the applicant’s direct linkage to the sport’s players, supporters and stakeholders worldwide. Furthermore, consistent with their global governance responsibilities, the IRB can be expected to ensure measured and responsible growth for this new gTLD in the best interests of the sport and with the full support of the global rugby community it will aim to serve.

The proposed string, .blog, is a common generic term relating to a market sector.

Charleston Road Registry Inc. is proposing to exclude any other entities, including potential competitors, from using the TLD.

Restricting common generic strings for the exclusive use of a single entity could have unintended consequences, including a negative impact on competition.

Early warnings provide a mechanism to initiate a discussion between a government and an applicant on particular issues or questions. It is intended that a constructive dialogue through this process will assist applicants to better understand the concerns of governments, and help governments to better understand the planned operation of proposed gTLDs.

Possible Remediation: 

Charleston Road Registry Inc. should specify transparent criteria for third party access to the TLD. These criteria should be appropriate for the types of risk associated with the TLD, and should not set anticompetitive or discriminatory conditions relating to access by third parties.

These criteria should form part of any binding contract with ICANN, and be subject to clear compliance oversight by ICANN.
