Comments on CWG-WCIT12/C-25

The SG3 RG-LAC presented the C - 25, proposing modifications in ITRs. Regarding the proposals of the C - 25, we have the following comments.

1. About the draft Article 6.

The SG3 RG-LAC proposed a new Article 6, as follows:

“1. Member States shall ensure transparency with respect to retail and wholesale prices, costs, and quality of service.

2. Member States should foster continued investment in high-bandwidth infrastructures.

3. Member States shall [take measures to] ensure that prices are oriented on costs. Regulatory measures may be imposed to the extent that this cannot be achieved through market mechanisms.

4. Member States shall take measures to ensure that an adequate return is provided on investments in network infrastructures. If this cannot be achieved through market mechanisms, then other mechanisms may be used.

5. Member States shall [take measures to] ensure that fair compensation is received for carried traffic (e.g. interconnection or termination). Regulatory measures may be imposed to the extent that this cannot be achieved through market mechanisms.
