Contribution to Article 2 for the Final Meeting of the CWG-WCIT12

This contribution of Digicel (Jamaica) Limited (“Digicel”) takes in consideration document CWG-WCIT12 TD 62 (Draft Compilation of Options).

Digicel´s contribution is guided by the following principles:

(1) the Preamble of the Constitution of the International Telecommunications Union (the “Constitution”) which recognizing the sovereign right of each State to regulate its telecommunications.

(2) Article 4(4) of the Constitution which reads as follows:

In the case of inconsistency between a provision of this Constitu­tion and a provision of the Convention or of the Administrative Regula­tions, the Constitution shall prevail. In the case of inconsistency between a provision of the Convention and a provision of the Administrative Regulations, the Convention shall prevail.

(4) Principles enunciated in Resolution 171 adopted at the ITU Plenipotentiary Conference in Guadalajara (México) 2010, which establishes that all proposal for revision to the ITRs be examined provided that those proposals:

i) are consistent with the purposes of the Union set forth in Article 1 of the Constitution;
